Overview

  • Justices Aravind Kumar and NV Anjaria extended interim protection from arrest and directed Malviya to post an apology on Facebook, Instagram and other platforms within 10 days.
  • Malviya, through advocate Vrinda Grover, told the court he has already tendered an apology by affidavit and will publish it on his social media accounts.
  • Additional Solicitor General KM Nataraj opposed deletion of the contested post due to the ongoing investigation, and the court barred removal at this stage.
  • The case stems from a complaint by RSS member Vinay Joshi over a 2021 caricature involving Prime Minister Narendra Modi and the RSS, with charges under new penal-code provisions and the Information Technology Act.
  • The Madhya Pradesh High Court had rejected anticipatory bail on July 3, and the Supreme Court listed the matter after 10 days to review compliance with the apology order.
