Supreme Court Extends Bar on Trial, Asks Haryana to Consider Withholding Sanction in Mahmudabad Case

The bench gave the state six weeks to clarify whether it will deny prosecution sanction, which would prevent the trial court from proceeding on the chargesheet.

Overview

  • Chief Justice Surya Kant and Justice Joymalya Bagchi extended the order restraining the Rai, Sonipat trial court from taking cognisance of the Haryana SIT chargesheet filed in August 2025.
  • Additional Solicitor General S.V. Raju told the court that prosecution sanction remains pending and sought time to get instructions on a possible one-time refusal.
  • The court indicated that if the state withholds sanction, it would not probe the merits and the matter could effectively be closed.
  • The bench said interim directions will continue and stressed that Ali Khan Mahmudabad must act responsibly if leniency is shown, with the case listed again in six weeks.
  • The case arises from two May 2025 FIRs over posts on Operation Sindoor; the Supreme Court earlier formed an SIT, later criticised its overreach, and confined the probe to the FIRs, with offences cited under BNS sections 152, 353, 79 and 196.
