Supreme Court Defers Hearing in Sonam Wangchuk Habeas Plea to Oct. 15

At issue is whether Wangchuk’s wife can see the grounds of detention to argue her habeas case.

Overview

  • A bench of Justices Aravind Kumar and N. V. Anjaria adjourned the matter to Wednesday after senior advocate Kapil Sibal sought time to appear before a special bench.
  • On October 6, the court issued notices to the Centre and Ladakh administration but declined interim relief, leaving disclosure of detention grounds to authorities under Section 8 of the NSA.
  • Solicitor General Tushar Mehta said the grounds were furnished to Wangchuk and need not be shared further, while the court recorded that his medical needs must be met under prison rules.
  • Gitanjali J. Angmo’s petition seeks Wangchuk’s production, immediate access, and quashing of the NSA order that followed September 24 Leh violence in which four civilians died.
  • Detained on September 26 and lodged in Jodhpur jail, Wangchuk faces allegations of incitement, even as a letter attributed to him calls for an independent judicial inquiry and urges non-violence.
