Supreme Court Declines to Remove MP Minister Over Derogatory Remarks on Colonel Qureshi

A Supreme Court bench is awaiting the SIT’s status report before addressing calls to strip Shah of his ministerial office.

Overview

  • Congress leader Jaya Thakur filed a writ petition citing Article 164(3), alleging that Shah’s reference to Col Qureshi as a “sister of terrorists” encouraged separatist sentiments and violated his oath.
  • A bench led by Justices Surya Kant and Dipankar Datta declined to entertain the removal plea, advising Thakur to seek alternate legal remedies.
  • The court has maintained Shah’s protection from arrest on condition he fully cooperates and continues to await a report from the three-member SIT.
  • The Supreme Court-mandated SIT, formed in May and including a woman IPS officer, is probing an FIR registered under sections 152, 196(1)(b) and 197 of the Bharatiya Nyaya Sanhita.
  • Shah’s May 11 comments linking Col Qureshi’s Muslim identity to terrorists during her Operation Sindoor briefings sparked national outrage and drew contempt warnings from the Madhya Pradesh High Court.
