Supreme Court Declines to Quash Case Over Babri Facebook Post After Plea Withdrawn

The court said the trial judge will weigh all defence claims on their own merit.

Overview

  • A bench of Justices Surya Kant and Joymalya Bagchi dismissed Mohd Faiyyaz Mansuri’s Special Leave Petition as withdrawn, refusing to entertain his challenge to the Allahabad High Court order.
  • During the hearing, Justice Kant noted the bench had read the post and cautioned counsel, saying, “Don’t invite any comment from us.”
  • The High Court on September 9 declined to quash the prosecution but directed an expedited trial after a Lakhimpur Kheri court took cognizance of the charges earlier this year.
  • An FIR filed on August 6, 2020 cited IPC Sections 153A, 292, 505(2), 506, 509 and Section 67 of the IT Act; Mansuri’s subsequent NSA detention was quashed by the Allahabad High Court in September 2021.
  • Mansuri argues his account was hacked and that objectionable remarks came from a commenter using the name ‘Samreen Bano’, alleged to be operated by Ritesh Yadav, while authorities closed proceedings against others.
