Overview

  • The Supreme Court on July 28 dismissed residents’ special leave petition and upheld MHADA’s use of the Construction and Development Agency model for Motilal Nagar, allowing Estatevue Private Developers to proceed.
  • The Rs 36,000-crore, seven-year project will redevelop 143 acres in Goregaon West, rehousing about 3,700 residents in 1,600-sq-ft apartments alongside 987-sq-ft commercial spaces and modern infrastructure.
  • Under the C&DA framework, MHADA retains land ownership while Estatevue bears all rehabilitation, infrastructure and amenity costs free of charge to the authority.
  • The Bombay High Court has appointed a two-member committee led by retired Justice J.P. Devadhar and Vilas D. Dongre to examine the validity of 935 notices issued under Section 79-A of the MHADA Act for cessed buildings.
  • The court ordered 889 of those notices to remain in abeyance pending resident consent and directed the immediate withdrawal of 46 notices after MHADA admitted relying solely on visual inspections without structural audits.
