Supreme Court Cites Three Acciona Executives as Suspects in Cerdán Public-Works Probe

The move follows raids triggered by a UCO report alleging a 2% kickback routed through Servinabar.

Overview

  • Judge Leopoldo Puente ordered former Acciona Construction chief Justo Vicente Pelegrini and executives Tomás Olarte Sanz and Manuel José García Alconchel to appear as investigados on December 3.
  • The judge partially lifted secrecy on a separate case file and directed analysis of documents and devices seized in last week’s searches at Acciona’s Madrid and Bilbao offices and at firms linked to the network.
  • An 11 November UCO report describes a pattern in which Acciona won public works and Servinabar received a net 2% fee, accounting for about 75% of Servinabar’s inflows.
  • Investigators place Santos Cerdán as the go-between with Transport officials and Acciona and say Servinabar, tied to him by private contracts, was used to channel payments.
  • Acciona says it cooperated with the Guardia Civil, previously cut ties with Servinabar, and dismissed Pelegrini in June, while Olarte and García Alconchel remain on staff according to court filings and company sources.
