Supreme Court Allows Live Streaming in Challenge to 26th Constitutional Amendment

An eight-judge bench will first decide a pending request for a full-court hearing before moving further.

Overview

  • The constitutional bench, led by Justice Ameenuddin Khan, convened to hear a cluster of petitions and unanimously opened the proceedings to live broadcast on the court’s YouTube channel.
  • The court ordered the appeal seeking a full-court bench, filed for Mustafa Nawaz Khokhar by lawyer Shahid Jameel, to be formally registered and taken up as the threshold issue.
  • The hearing was adjourned until 11:30 am Wednesday after the bench indicated it will settle the forum question before considering other matters.
  • Petitioners from PTI, multiple bar associations, civil society and former judges contest the amendment’s validity, including whether it secured the required two‑thirds parliamentary majority.
  • The 2024 amendment recast judicial powers and appointments by removing Article 184(3) suo motu jurisdiction, fixing a three‑year CJP term, empowering a parliamentary committee to nominate the CJP, restructuring the JCP, altering bench formation, and mandating elimination of riba by January 1, 2028.
