Supreme Court Allows Green Firecracker Production in Delhi-NCR, Keeps Sale Ban in Place

The court directed the Centre to submit a stakeholder-backed plan by October 8 to craft an enforceable policy for Delhi-NCR.

Overview

  • NEERI- and PESO-certified manufacturers may resume making green firecrackers in the region, subject to written undertakings not to sell in prohibited areas.
  • The year-round bar on sale and storage in Delhi-NCR remains in force until further orders, so distribution within the region is still prohibited.
  • A bench of CJI B.R. Gavai and Justices K. Vinod Chandran and N.V. Anjaria asked the environment ministry to consult Delhi, manufacturers and traders and file a concrete framework by October 8.
  • The court said absolute bans are rarely workable and cited Bihar’s mining prohibition to urge a balanced approach that curbs pollution without driving illegal markets.
  • CAQM told the court it found no conclusive link between crackers and overall pollution and recommended stronger, year-round monitoring and verification of green formulations.
