Sunarp Lets Notarized Private Papers Replace Public Deeds for Some Condo Rule Changes

Matching article 89 to article 86 aims to lower notarial costs, speed registrations, and bring uniform rules to registrars.

Overview

  • Sunarp published the amendment at the end of July, changing article 89 so owners can register unilateral changes to building or condominium rules with a private document notarized by a notary when other units are not affected.
  • The rule treats modification requirements the same as initial inscription under article 86, ending divergent practices where some registrars demanded a public deed and others accepted private notarized documents.
  • Sunarp says the change will cut the direct cost of the procedure and shorten processing times because private notarized documents are faster and cheaper to prepare than a escritura pública.
  • The measure is expected to ease common transactions such as independizaciones, inheritance regularizations, staged project approvals and sales closings, helping owners, notaries and developers move cases that were previously delayed.
  • Sunarp registered nearly two million titles in the first half of 2026, showing the scale of the registry system that stands to gain predictability and reduced backlog from this administrative simplification.
