Students Accuse Transgender Athlete at Center of West Virginia Sports Case Before Supreme Court

The ACLU says the school deemed the complaints unsubstantiated ahead of next week’s Supreme Court arguments.

Overview

  • Two West Virginia students, Adaleia Cross and Emmy Salerno, publicly alleged harassment and intimidation by a transgender athlete whose case on girls' sports is before the U.S. Supreme Court.
  • Cross says explicit locker room remarks occurred in 2022–2023 when both were in middle school, and she later quit high school track to avoid sharing facilities with the athlete.
  • Salerno alleges the athlete stared at and followed her after she and other girls refused to compete in shot put in spring 2024, leading to a team disqualification, and she cites a Snapchat post as part of the intimidation.
  • The ACLU, which represents the athlete, denies the Cross family’s allegations and says the school found those reported claims unsubstantiated, and it did not provide comment on Salerno’s claims in the reports.
  • The lawsuit, filed in 2021, blocked West Virginia’s ban on transgender girls in school sports; an appeals court upheld that ruling in April 2024, the Supreme Court will hear arguments Jan. 13, and more than 130 congressional Democrats filed an amicus brief supporting the athlete.
