STM Makes Roberto Jefferson a Defendant Over Alleged False CAC Declarations
Reversing a March dismissal, the court sent a military criminal complaint about alleged false firearms‑registration statements back to first‑instance military court.
Overview
- The Superior Tribunal Militar ruled unanimously late Thursday, Oct. 29, that the Justiça Militar da União must receive a Ministério Público Militar complaint, which formally makes Roberto Jefferson a defendant and returns the case to first instance.
- The accusation targets two declarations Jefferson gave to the Army in CAC (hunter, sport‑shooter and collector) procedures on Aug. 27, 2020 and Feb. 18, 2021 in which he said he did not face criminal proceedings and had clean antecedents.
- The inquiry began after an anonymous tip to the MPM’s ouvidoria in December 2022 that said Jefferson kept an active CAC while answering criminal cases, moved his registration between military regions, registered weapons and bought ammunition.
- The MPM relies on Jefferson’s 2012 Mensalão conviction as a key factual basis, arguing that a 2016 indulto only ended the penalty and did not erase effects of the conviction for background checks used in CAC decisions.
- Jefferson remains in house arrest with an electronic monitor and travel and communications limits, and the case will now proceed in the 1st Auditoria of the 11th Circunscrição Judiciária Militar in Brasília where prosecutors will seek to prove the alleged false statements.
