STF Temporarily Bars Fines Under NR‑1 Psychosocial Rules

The court paused punitive enforcement for 90 days to send the dispute to Nusol for conciliation aimed at adding objective criteria for sanctions.

Overview

  • On Thursday, June 25, STF minister André Mendonça issued a 90‑day injunction that prevents autuações, fines and other coercive sanctions from being based on the NR‑1 provisions dealing with psychosocial risks.
  • The decision leaves the NR‑1 preventive duties in force, so employers must still identify, evaluate and manage work factors such as excessive workload, pressure and harassment as standards to be observed.
  • Mendonça sent the case to the Supremo’s Núcleo de Solução Consensual de Conflitos (Nusol) and ordered negotiated hearings over the next 90 days to produce clearer, more objective wording for which conduct may be sanctioned.
  • The injunction does not block enforcement under other labor or health rules, allows the government to issue guidance, and will be submitted to a virtual plenary review of the full STF between August 7 and 18.
  • If conciliation yields objective criteria, the relator will reassess the matter and sanctions could resume; meanwhile workers may see fewer immediate penalties for employers while the rule’s legal clarity and real‑world application are debated.
