Overview
- The court suspended the case after a 5–4 split on whether to fully or only partly validate the Union–Axia settlement.
- Kássio Nunes Marques, Cristiano Zanin, André Mendonça, Dias Toffoli and Gilmar Mendes backed full homologation.
- Alexandre de Moraes favored only validating the increase in government seats and was joined by Flávio Dino, Cármen Lúcia and Edson Fachin.
- The agreement keeps the 10% voting cap but lets the federal government appoint three of Axia’s ten directors and one of five Fiscal Council members.
- The deal also releases Axia from funding the Angra 3 nuclear project, and the case stems from a 2023 challenge to the voting cap as the Union holds about 43% of shares.
