STF Holds 3–0 to Keep Ban on Eduardo Bolsonaro and Ramagem Amendments as Bolsonaro Files New Appeal

The latest votes endorse Flávio Dino’s view that a parliamentary mandate cannot be exercised from abroad.

Overview

  • In the STF’s virtual session, Flávio Dino, Alexandre de Moraes and Cármen Lúcia voted to uphold the order blocking execution or receipt of amendments indicated by Eduardo Bolsonaro and Alexandre Ramagem, with the vote open until February 6.
  • Dino’s decision, taken in December, bars roughly R$80 million in amendments identified in a PSOL action and rests on the position that lawmakers living in the United States cannot legitimately perform their mandates.
  • The Chamber’s board declared the loss of Eduardo Bolsonaro’s and Ramagem’s mandates on December 18 after prolonged absence and a conviction, respectively, and both remain in the U.S.
  • Separately, Jair Bolsonaro’s lawyers filed an agravo regimental on January 12 seeking admission of embargos infringentes or a transfer of his attempted‑coup case to the full court so that Luiz Fux’s lone dissent could prevail.
  • Moraes has previously rejected infringentes under STF precedent requiring at least two defense votes in Turma judgments, and Bolsonaro is serving a 27‑year, 3‑month sentence as the new appeal—citing late evidence disclosure, free‑speech claims and challenges to the criminal organization charge—awaits a ruling.
