Spanish Divorces Rebound 8.2% in 2024 but Stay Below Pre-Pandemic Levels

Shared custody now leads most proceedings with non-contentious divorces remaining the norm

  • Divorces climbed 8.2% to 86,595 in 2024 after two years of decline, yet figures remain under the more than 90,000 recorded in 2021 and far below pre-pandemic peaks.
  • Custody shared arrangements reached 49.7% of cases involving minors, surpassing maternal custody for the second consecutive year and underscoring a shift toward co-parenting.
  • Non-contentious divorces accounted for 79.8% of filings, while separations rose 6.6% to 3,604 and notarial procedures for mutual agreements without minors grew to 13.8%.
  • The average age at divorce was 49 for men and 46.6 for women, marriages lasted 16.6 years on average, and same-sex couples made up 2.6% of all divorces with 2,121 cases.
  • Regional trends diverged sharply: Murcia saw a 28% surge in dissolutions, Andalusia recorded a 10.2% rise in divorces but a 44% drop in separations, and Ceuta posted the highest rate at 2.3 per 1,000 inhabitants.
