Spain's DGT Proposes Tougher Traffic Rules With Lower Alcohol Limit

The package is still under review with implementation expected late 2025 or early 2026.

Overview

  • Parliamentary bills would set a new blood alcohol threshold at 0.1 mg/l in breath (0.2 g/l in blood) with tiered penalties of €200 and 2 points, €500 and 4 points, and €1,000 and 6 points depending on the reading.
  • Planned curbs on dangerous overtakes, including on snow or ice and across continuous lines, carry €200–€400 fines and the loss of four license points.
  • Motorcyclists would be required to wear full-face or modular helmets on interurban roads, and bikes could use the right hard shoulder in traffic jams below 30 km/h, with €200 fines for violations.
  • Drivers would be obliged to form an emergency corridor on motorways during tailbacks to let police and ambulances pass, with a €200 penalty for noncompliance.
  • The DGT says the measures aim to cut road deaths; RACE describes the package as stricter, some offenses could face criminal processing, and formal approval is still pending.
