Spain’s Constitutional Court Admits Puigdemont Appeal on Amnesty, Puts Arrest Order Under Review

The tribunal signals it will await a pending EU judgment before ruling on whether the amnesty covers the malversation case.

Overview

  • Judges voted 8–4 to hear the appeal, with conservative magistrate César Tolosa joining the majority and four conservative members dissenting.
  • The court also admitted appeals from former Catalan officials Toni Comín and Lluís Puig, adding to earlier filings by Oriol Junqueras, Jordi Turull, Raül Romeva and Dolors Bassa.
  • The national arrest warrant for Puigdemont remains in force as a separate procedural track is opened to consider his request to suspend it.
  • Sources indicate suspension of the warrant is unlikely before a decision on the merits, and the court will first hear from the Prosecutor’s Office, the State Legal Service and Vox.
  • After recusation challenges delayed the timetable, the court aims to resolve the amparo cases in the first quarter of 2026, factoring in a possible EU Court of Justice ruling expected in November.
