Overview

  • The measure was added to the draft Sustainable Consumption Law and is now awaiting approval by the Council of Ministers.
  • It would amend Article 20 of the Consumer Defense Law to cap resale markups at the variation in the consumer-price index between original purchase and resale.
  • Any resale pricing above the CPI cap would be classified as illicit, empowering authorities to block non-compliant platforms and impose fines.
  • The proposal builds on an existing ban on ticket-buying bots under Article 27.6 of the 1991 Unfair Competition Law, which has proven ineffective in preventing bulk purchases and price gouging.
  • Spain follows France and Belgium in regulating secondary ticket markets as Europe’s resale sector is projected to quadruple by 2030 with Spain making up roughly 10–15% of the market.
