Overview
- The Ministry of Health published the draft Royal Decree under Law 3/2024 to widen its accelerated support framework beyond ALS to cover other high-complexity irreversible conditions.
- It sets four cumulative eligibility criteria requiring irreversible disease with severe structural and functional damage, no recovery expectation, rapid clinical decline within six months and the need for continuous complex home care.
- A non-exhaustive annex lists illustrative conditions such as progressive muscular atrophy, primary lateral sclerosis, transmissible spongiform encephalopathies, locked-in syndrome and non-responding spinal muscular atrophy types I and II.
- The draft is open for public consultation before final redrafting begins in September and submission to the Council of Ministers for approval.
- After BOE publication, regional administrations will use the common administrative procedure to evaluate applications at patients’ or legal representatives’ request.
