Overview

  • On July 7, the Boletín Oficial del Estado published an order repealing the 1987 regulation that barred organ donation between people with HIV
  • The repeal, now in force, allows people with HIV to donate organs to HIV-positive recipients under Spanish law
  • The Organización Nacional de Trasplantes will establish and monitor protocols for HIV-to-HIV transplant outcomes to be adopted by the Transplant Commission of the Interterritorial Council
  • Data from the last decade suggest 65 deceased HIV-positive donors could have enabled up to 165 transplants and each year about 50 HIV-positive patients join Spain’s organ waitlist
  • Spain joins South Africa and the United States in allowing HIV-to-HIV organ donations as it aims to expand its donor pool and reduce social stigma
