São Paulo Electoral Court Reverses One Marçal Ineligibility Ruling as Separate Case Remains Pending

The reversal cites insufficient proof after the case was built largely on a single video.

Overview

  • TRE-SP unanimously accepted Pablo Marçal’s appeal in one case and rejected the action that had made him ineligible.
  • Relator Claudio Langroiva said the record did not show the reach, financial flows or electoral impact needed to sustain the conviction.
  • That overturned case stemmed from allegations that Marçal offered video endorsements to council candidates in exchange for R$5,000 donations.
  • In a separate appeal on paid dissemination of edited video clips, Langroiva voted to keep an eight-year ineligibility and a R$450,000 fine for misuse of media while dropping other counts.
  • Judge Régis de Castilho requested a review and suspended that second judgment, which is scheduled to resume on December 4, with the actions originally filed by PSB and the PSOL coalition.
