The watchdog determined they acted on a reasonable belief that Kabera wielded what officers mistook for a firearm.

Overview

  • The SIU report found no reasonable grounds to charge the two officers after a more than 200-day investigation into the Nov. 9 shooting.
  • Officers fired as many as 24 rounds after Kabera advanced in a fifth-floor hallway holding a replica handgun that resembled a semi-automatic pistol.
  • An autopsy confirmed Kabera died from multiple gunshot wounds at Hamilton General Hospital in the early hours of Nov. 10.
  • One officer declined to be interviewed by the SIU but submitted her notes, and the other agreed to an interview.
  • Kabera’s family described the findings as disappointing and is exploring legal action while the Hamilton Police Service pledges to meet with his relatives and community leaders.
