SEPE Clarifies Unemployment Aid Rules: Internship Pay Exempt, Part-Time Work Allowed, Disciplinary Firings Valid

The agency set out how the reformed system applies in practice, detailing income limits, compatibility conditions and payment schedules now in force.

Overview

  • SEPE confirmed that a disciplinary dismissal is a legal unemployment situation for accessing the benefit or subsidio, unless fraud is proven, in which case paid amounts may be reclaimed.
  • Payments received for training internships do not count as income for means testing, internships are compatible with benefits since November 1, and interns must be registered with Social Security since January 1, 2024.
  • Workers on part-time contracts can receive the subsidio if their gross income stays below 75% of the SMI (€888 per month in 2025), with household averaging applied when there are family responsibilities.
  • For a 50% working day, SEPE outlined a trimester payment path of €420, €270, €180, €120 and then €60, with compatibility capped at a maximum of 180 days.
  • The Complemento de Apoyo al Empleo allows combining the subsidio with new employment for up to 180 days per job, with a tapering supplement (e.g., €480 down to €120 full-time; €450 to €30 part-time) and a gross salary cap of €2,250 per month.
