Senate Suspends Conanda Resolution on Abortion Access for Children

Overview

• The Federal Senate approved Project of Legislative Decree (PDL) 3/2025 on June 2, 2026, which suspends Resolução nº 258/2024 of the National Council for the Rights of Children and Adolescents (Conanda).
• As a PDL, the suspension takes effect without presidential sanction and the measure will be promulgated by Congress after the Senate vote.
• Conanda’s resolution had set uniform procedures to speed and humanize care for child and adolescent victims of sexual violence, including allowing minors under 14 to seek legal abortion regardless of gestational age and permitting exceptions to police reports, court authorization or guardian notification in certain cases.
• Supporters of the PDL, led by relator Sen. Damares Alves and author Dep. Chris Tonietto, say Conanda exceeded its authority; opponents including Conanda, the Ministry of Rights and civil-society groups call the move a “grave retrocesso” and plan a constitutional challenge at the STF with PSOL as plaintiff.
• With the national protocol suspended, health services will no longer have a single set of guidelines, creating a risk of uneven access and delays for victims and making the pending STF litigation the key next step to determine institutional competence and practical protection.
