Overview
- The Senate Constitution and Justice Commission finished its analysis of PEC 18/2025 on Wednesday and sent the proposal to the full Senate, where two rounds of voting with a three-fifths (49-vote) threshold are required.
- The PEC would add a National Unified Public Security System (SUSP) to the Constitution to coordinate actions among the federal government, states, the Federal District and municipalities.
- The text imposes harsher sentences and special prison regimes for leaders and members of organized criminal groups and establishes a System of Penal Policies to reorganize custody and prison administration.
- It creates binding funding rules by requiring that 50% of the Fundo Nacional de Segurança Pública and the Fundo Penitenciário Nacional be transferred to states and municipalities and by directing 10% of the Social Fund surplus to security funds.
- Senate leaders have signaled a push to fast-track plenary votes before the election second round so the measure can be promulgated and allow the executive to create a Ministry of Public Security, but any Senate changes would send the text back to the Chamber and could delay that outcome.
