• The Senate approved PL 1049/2026 that establishes a National Policy for students with high abilities or giftedness and the text was sent to the president for sanction on May 27, 2026.
• Schools must run an annual pedagogical triage to flag students for follow-up; the triage is indicative, confidential and not a clinical diagnosis.
• Formal identification will require multidisciplinary evaluation and, in cases of double exceptionality, biopsychosocial or neuropsychological assessment before special educational measures are applied.
• The law guarantees tailored responses such as subject acceleration, curricular deepening, interest-based grouping and enrichment programs, and it creates centers of reference offering after-school services and specialist infrastructure.
• Funding is specified from sources including the Social Fund of pré-sal, fixed-quota betting revenues, salário-educação directed to Fundeb and PAC infrastructure funds, but states and municipalities will need trained staff and resources to close gaps revealed by the 2025 School Census.
