Senate Approves Decree That Nullifies Conanda Guidelines on Minors' Abortion

If promulgated the legislative decree can take effect without presidential sanction and will change how health and protection services handle legal abortion for children and adolescents.

  • The measure annuls Conanda’s Resolução nº 258/2024, a normative guidance issued in January 2025 that aimed to guarantee humanized access to legal abortion for minors in cases of rape, risk to life, and anencephaly.
  • Under Brazil’s PDL rules the decree can enter into force without the president’s sanction once it is properly promulgated, and outlets differ on whether the text will go straight to promulgação or return for further formal transmission.
  • The PDL was authored by deputy Chris Tonietto and carried in the Senate by rapporteur senator Damares Alves, with votes taken rapidly and with limited debate and low attendance from many opposition senators.
