Overview

  • The injunction blocks five sections of the March 25 order, including a requirement for documentary proof of citizenship on the federal voter registration form.
  • The order had also sought to bar mail-in ballots received after Election Day and condition federal election grant funding on state compliance.
  • Casper wrote that only Congress can amend voter-registration requirements and that the Election Assistance Commission must follow notice-and-comment rulemaking.
  • Democratic attorneys general from 19 states sued in April, saying the executive order usurped their constitutional power over election administration.
  • This ruling follows a similar April injunction by a D.C. judge and the administration has indicated it will appeal the latest decision.
