SEC Case Against Adanis Stalled as India Delays Service of Summons

Indian authorities have not delivered the SEC summons to the Adanis, leaving the civil lawsuit on hold

Overview

  • The SEC’s Aug. 11 status report confirms it has not effected formal service of the summons and complaint on Gautam and Sagar Adani in India.
  • Service efforts include diplomatic requests to India’s Ministry of Law & Justice under the Hague Service Convention and direct Notices of Lawsuit and Requests for Waiver of Service to defendants and their counsel.
  • Under Federal Rule of Civil Procedure 4(f), formal service abroad is required before the civil case can move to discovery or trial, creating a procedural impasse.
  • The November 2024 complaint accuses the Adanis of making false statements in a $750 million Adani Green bond offering and of a Rs 2,029 crore bribery scheme tied to solar power contracts.
  • The Adani Group maintains the allegations are baseless, and the SEC is due to file its next status update with Magistrate Judge James R. Cho by Oct. 13, 2025.
