SAPS Legal Chief: Mchunu Lacked Authority to Disband KZN Political Killings Team

Her testimony underscored that operational control rests with the national commissioner.

Overview

  • Maj-Gen Petronella van Rooyen told the Madlanga commission that only National Commissioner Fannie Masemola could lawfully disband the PKTT and that the minister’s December 31 directive strayed into operations.
  • She testified suspended deputy commissioner Shadrack Sibiya had no authority to carry out or implement the minister’s instruction or to move PKTT dockets, citing the duty to refuse manifestly illegal orders.
  • Van Rooyen said key stakeholders were not consulted before the directive, naming Masemola, KZN commissioner Nhlanhla Mkhwanazi, PKTT project lead Dumisani Khumalo and the KZN Director of Public Prosecutions.
  • The SAPS legal head faulted Parliament’s police portfolio committee for failing to act on Mkhwanazi’s March allegations, noting an ad hoc committee will open public hearings on October 7.
  • In earlier testimony, Masemola described a leadership struggle involving suspended deputy Sibiya and linked allegations around businessman Vusimuzi ‘Cat’ Matlala, while confirming the PKTT remains operational as the inquiry adjourns until Friday.
