Santa Fe Convention Approves Judicial Overhaul With 7-Member Court and Independent Ministerio Público

The Legislature now has two years to pass implementing laws under transitory rules that preserve incumbents plus pending processes.

Overview

  • Delegates approved core constitutional changes 49–19, expanding the Supreme Court to seven members with gender parity, territorial representation and retirement at 75.
  • The reform creates an independent Ministerio Público outside the judiciary, splitting it into a prosecutorial MPA and a Defense branch led by chiefs appointed by the governor with Legislative agreement.
  • A new Selection Council will run transparent public competitions, and a reconfigured Tribunal de Enjuiciamiento will try serious misconduct by judges, prosecutors and defenders.
  • Transitory clauses keep current officeholders and ongoing selection and disciplinary cases in place, convert Procurador General Jorge Barraguirre to the new role for the remainder of his term, and maintain current rules until new laws are enacted.
  • After close debate on personnel rights, two worker-related clauses passed 35–32, and the Convention set September 12 for final approval of the stenographic text and the swearing-in ceremony.
