Santa Fe Appeals Court Confirms 12-Year Sentence for Teacher Convicted of Abusing Five Pupils

The defense now faces a ten-day window to seek constitutional review.

Overview

  • A panel of judges Fabio Mudry, Fernando Gentile Bersano and Bruno Netri unanimously rejected the defense’s horizontal appeal and upheld the June 24 ruling imposing 12 years in prison.
  • The conviction covers four counts of gravely outrageous sexual abuse and one count of simple sexual abuse, all aggravated by the defendant’s role as educator, against five girls at the Ceferino Namuncurá kindergarten in Santa Fe’s Yapeyú neighborhood in 2021.
  • The court rejected the defense’s “inoculation” or collective suggestion theory and affirmed an evaluation of the evidence using vulnerability, gender and childhood perspectives.
  • Judges noted the unexplained loss of recordings from 32 school security cameras, declined to attribute responsibility to prosecutors or police, and sent the file to the MPA’s Auditoría General de Gestión for review.
  • The chamber revoked an order to forward copies to the provincial Justice and Security Ministry regarding possible police misconduct, stating the affected parties may pursue their own actions.
