Sam Wood Appeals After Second Bail Refusal on Domestic Violence Charges

Lawyers say the Supreme Court failed to weigh likely pre-trial custody or the effect of proposed bail conditions, and they have sought an expedited Court of Appeal hearing.

Overview

  • Wood was arrested in Noosa on October 3 and charged with one count each of assault occasioning bodily harm and strangulation, and he has been held on remand after magistrate and Supreme Court judges refused bail.
  • Justice Patrick McCafferty quoted witness accounts that said Wood had several drinks, made threats including that the pair could “both die,” and that his wife alleged he grabbed her throat and caused gasping.
  • Prosecutors told the court Wood posed an unacceptable risk of reoffending or of interfering with witnesses, and the judge found proposed bail conditions would not reduce that risk to an acceptable level.
  • Defence counsel denies the allegations, offered a $1 million surety and supervised residence options including living with family in Tasmania, and will argue on appeal that the bail refusals were unreasonable or plainly unjust.
  • The Court of Appeal filing asks for an expedited hearing, possibly within three weeks or as soon as November 6, and will also challenge the refusal to order non-publication of an uncharged 2021 allegation that was mentioned in the bail hearing.
