Río Cuarto Court Dismisses Case Against Last Suspect in Nora Dalmasso Murder as Time-Barred

Judges applied Argentina’s 15-year limit for the charged offense, ending prosecution despite late DNA matches that led to a 2024 indictment.

Overview

  • The Cámara Criminal, Correccional y de Acusación de 2° Nominación ordered the total dismissal of Roberto Marcos Bárzola, declaring the criminal action extinguished by prescription.
  • The ruling notes nearly 19 years have passed since the 2006 killing and that, under Penal Code article 62(2), the 15-year limitation had lapsed, at least since November 2021.
  • Judges rejected claims that the period should pause while Marcelo and Facundo Macarrón were investigated and also refused to classify the case as imprescriptible.
  • Forensic testing linked Bárzola’s DNA to the robe belt used to strangle Dalmasso and to a pubic hair, after more than 150 comparisons and reported FBI confirmation, prompting a December 2024 charge of sexual abuse with death.
  • The Dalmasso family, represented by attorney Ángeles Mussolini, denounced the decision, say they want an ordinary criminal trial, and plan to appeal as the ruling is not yet final.
