Ritchie Torres Introduces 'River's Law' to Ban Pools at Home Day Cares and Require Alarms

The proposal follows inspectors missing hazards before a toddler drowned at a licensed Bronx day care.

Overview

  • Torres’ bill would prohibit swimming pools at residential day care centers and require door, window or pool alarms to prevent unsupervised access.
  • River Wilson, 20 months old, was found unresponsive on Aug. 1 in a backyard pool at Ana's Butterfly Garden Family Group in the Bronx, and investigators say no alarms or safety measures were in place.
  • State records reviewed by reporters show inspectors flagged the pool as noncompliant hours after the death, citing proximity to the house and a fence that was too short, despite prior visits recording compliance.
  • The day care later lost its license, no criminal charges have been filed to date, and the operator told police she was cooking when the child went through a back screen door to the pool area.
  • River’s family stood with Torres to back the legislation, as advocates point to CDC data that drowning is the leading cause of death for children ages 1 to 4.
