Rights Group Sues to Halt Argentina’s Intelligence Overhaul by Decree

Plaintiffs argue the decree lacks the necessity and urgency required to bypass Congress.

  • CELS filed a federal amparo to nullify the decree, sought an immediate injunction, requested activation of the judicial recess, and reserved a per saltum to the Supreme Court.
  • Additional suits were brought by former officials Leopoldo Moreau, Federico Storani, Ricardo Alfonsín and Manuel Garrido, plus a separate filing by deputies Maximiliano Ferraro, Esteban Paulón and Mónica Frade.
  • The cases landed with Judge Martín Cormick and with Federal Administrative Court No. 4 under Judge Rita Alián, who must first decide on precautionary measures.
  • The DNU classifies all intelligence as “covert”, authorizes agents to “apprehend” in intelligence operations, by judicial aid, or in flagrante, with immediate intervention by security forces.
  • The measure remains in effect as the government defends a streamlining that redefines agency roles and eliminates the DNIEM.
