Retired Nevada Justice Sues Real Water Over Husband’s ALS Death

The case joins a string of Nevada lawsuits that have already produced multibillion-dollar verdicts against the shuttered brand.

  • The complaint, filed Tuesday in Clark County District Court, alleges hydrazine in Real Water caused the ALS that killed Justice Abbi Silver’s husband, Kirk Jaster.
  • Jaster was diagnosed with ALS in February 2022; Silver resigned from the Nevada Supreme Court that August to care for him, and he died in September 2024.
  • The lawsuit, brought by Kemp Jones LLP, seeks at least $15,000 in damages, a standard Nevada pleading amount, and plaintiffs’ lawyer Will Kemp said it is the fifth case tying the brand to a death.
  • Real Water, marketed by Affinitylifestyles.com as “the healthiest drinking water available,” ceased operations in June 2021 and filed for Chapter 7 bankruptcy two months later.
  • Previous cases have yielded massive awards, including $3.8 billion to more than 60 victims in March 2024, $3 billion to eight plaintiffs in June 2024, a $5.2 billion verdict in October 2024, and a $228 million settlement in October 2023.
