Punjab & Haryana High Court Orders Punjab to Decide Amritpal Singh’s Parliament Parole in 7 Days

The bench asked the state to treat his request as a formal Section 15 NSA application permitting temporary release to attend the Winter Session.

Overview

  • A division bench of Chief Justice Sheel Nagu and Justice Sanjiv Berry set a seven-day deadline, saying the decision should preferably come before the session opens on December 1.
  • The court directed the Punjab government to process his existing representation as the application after the state argued no proper format had been submitted.
  • Amritpal Singh seeks temporary release or escorted attendance for the December 1–19 Winter Session under Section 15 of the NSA, which allows parole in exceptional circumstances.
  • During the hearing, the bench asked about the status of his NSA detention and what issues he plans to raise, and the Union said only the competent state authority can grant permission.
  • Singh remains in Dibrugarh Central Jail under the NSA since April 2023, won the Khadoor Sahib seat while in custody, and previously received a four-day escorted release in July 2024 to take his oath.
