Psychiatrists Outline Insanity and Diminished Responsibility in Cork Hospital Killing Trial

The accused has denied murder, entering a plea of manslaughter by reason of diminished responsibility.

Overview

  • Jurors heard Garda interviews in which Dylan Magee said he hit Matthew Healy "probably over 20 times" because he believed the 88-year-old had kidnapped his son.
  • Defence psychiatrist Stephen Monks testified that Magee was in acute withdrawal delirium, did not understand the nature of his actions, and could not refrain from them.
  • Prosecution psychiatrist Richard Church said Magee was severely impaired and unable to stop, while indicating he retained some awareness that the act was wrong, leaving both insanity and diminished-responsibility verdicts open.
  • Assistant State Pathologist Margaret Bolster told the court Mr Healy died from cardiac arrest due to brain and spinal cord injury, complicated by aspiration of blood from blunt force trauma, with extensive fractures and blood spatter recorded.
  • Evidence outlined that both men were sharing a ward at Mercy University Hospital, staff had noted Magee’s agitation despite sedatives and a special care assistant, and the 5.15am assault included the shouted claim, "this man ate my son".
