Overview

  • Federal prosecutors filed an appeal arguing that bail conditions cannot assure Abrego’s appearance or public safety, asking for his detention pending trial.
  • Judge Waverly Crenshaw will hold a hearing Wednesday to decide whether to reverse the magistrate judge’s order that freed Abrego on bail.
  • The Department of Homeland Security has signaled it will detain him immediately upon release with plans to deport him to a non-origin country such as Mexico or South Sudan.
  • Abrego has pleaded not guilty to a two-count federal indictment accusing him of leading an immigrant smuggling ring after his June return under a Supreme Court mandate.
  • His defense warns that immediate removal would deny him the chance to challenge the deportation and access due process before trial.
