Prosecutors Seek Death Penalty for Ex-President Yoon Over 2024 Martial-Law Move

A Feb. 19 verdict will test South Korea’s long-dormant use of capital punishment.

Overview

  • At a Jan. 13 hearing in Seoul, a special-investigator team led by Cho Eun Suk asked the Central District Court to sentence Yoon Suk Yeol to death on a rebellion charge.
  • The court is expected to deliver its ruling on Feb. 19, according to Yonhap.
  • Yoon faces multiple counts, including rebellion and abuse of power, tied to his Dec. 3, 2024 declaration of martial law that briefly brought troops to surround the National Assembly before lawmakers overturned the decree.
  • Investigators argued the move violated the constitution by crippling the legislature and the election commission and said Yoon has shown no remorse.
  • The defense insists the declaration was within presidential authority, as observers note executions have not been carried out in South Korea since 1997 despite capital punishment remaining on the books.
