Prosecutor Opposes Efforts To Recuse Judges in David Sánchez Trial

The Extremadura high court will decide after receiving reports from the three challenged magistrates.

Overview

  • The case prosecutor, Begoña García Boró, asked that the recusal bids be rejected, arguing the claims are insufficient and must be proven with objective data.
  • The challenges target José Antonio Patrocinio Polo, Emilio Francisco Serrano and María Dolores Fernández Gallardo for alleged loss of neutrality after prior rulings in the case.
  • The Tribunal Superior de Justicia de Extremadura will rule on the requests once it receives the judges’ reports, and granting any one motion would remove the panel.
  • Recusal petitions were filed by David Sánchez and four former Badajoz provincial officials: Juana Cinta Calderón, Francisco Martos, Manuel Candalija and Emilia Parejo.
  • The trial start was rescheduled to May 28 from February 9 due to counsel availability, with the panel decision pending before proceedings can move forward.
