Pollack Moves to Remove Bruce Fein From Maduro’s SDNY Defense After Disputed Entry

The judge has not ruled on Pollack’s bid to strike Fein from the docket.

Overview

  • Barry J. Pollack filed a sworn declaration on Jan. 8 stating Nicolás Maduro did not authorize Bruce Fein to represent him and authorized Pollack to seek Fein’s removal.
  • The court had granted Fein’s pro hac vice admission earlier on Jan. 8, adding him to the case docket before Pollack challenged his authorization.
  • Pollack said he attempted to reach Fein by phone and email to ask the basis for his claimed representation and received no response.
  • Fein told Judge Alvin K. Hellerstein that intermediaries close to Maduro sought his assistance, acknowledged he has had no direct contact with Maduro, and suggested the judge privately confirm Maduro’s preferences.
  • Both Pollack and Fein remain listed as counsel as a separate filing seeks retroactive compensation for David Wikstrom’s preparatory work as prospective court-appointed counsel.
