PHC Moves to Resolve Oath Hurdle After Afridi Wins KP CM Vote

Judges sought clarity on the governor’s role to prevent a power vacuum.

Overview

  • PTI’s Sohail Afridi was elected KP chief minister with 90 votes after opposition parties boycotted the session and walked out, calling the process unconstitutional.
  • The Peshawar High Court directed the additional advocate general to verify Governor Faisal Karim Kundi’s availability to administer the oath in Afridi’s case under Article 255.
  • Petitioners also asked the court to empower the assembly speaker or another official to administer the oath if the governor is not available.
  • Governor Kundi questioned the authenticity of outgoing CM Ali Amin Gandapur’s resignation due to mismatched signatures and summoned him on October 15 at 3 p.m. for in-person verification.
  • The assembly proceeded with the election despite the unresolved resignation dispute, and the court cautioned that further delay in the swearing-in would disrupt provincial governance.
