Peru's SBS Expands Sanctionable Conduct to Include Interest‑Charge Errors

The change gives the regulator clear legal grounds and monetary thresholds to punish interest‑calculation mistakes, requiring banks, AFPs and insurers to update compliance systems.

Overview

  • The Superintendencia de Banca, Seguros y AFP (SBS) formalized the update in Resolución SBS N.° 01923-2026 on Friday and Saturday, July 24–25, 2026, by revising its Reglamento de Infracciones y Sanciones (RIS).
  • The RIS now explicitly treats incorrect application or settlement of interest as a sanctionable offense and sets harm thresholds of 20 UIT (S/110,000) for grave infractions and 100 UIT (S/550,000) for very grave infractions.
  • The revision adds bank-specific infractions such as granting related-party loans on preferential terms, late reporting of loan-portfolio transfers and using risk models that lack required SBS approval.
  • AFP obligations were expanded to cover disability evaluation procedures, the operation of AFP medical committees, contribution accreditation and collection timelines, and insurers face new rules on coverage denials, investment registration and delayed payments.
  • The SBS says the aim is to modernize oversight and strengthen consumer protection; the resolution creates clearer enforcement paths but the coverage reports no immediate sanctions or implementation timetable following publication.
