Peru’s Judiciary Archives ‘Cócteles’ Case, Lifting Curbs on Keiko Fujimori

A national court enforced the Constitutional Court’s 2025 decision, which found the core charges lacked a legal basis under the principle of legality.

Overview

  • The Tenth National Preparatory Investigation Court executed the ruling and ordered the definitive dismissal, lifting all personal and property measures imposed on Fujimori.
  • The dismissal covers more than 30 co-defendants and the party Fuerza Popular, including Pier Figari, Ana Herz, Jaime Yoshiyama and José Chlimper.
  • The Constitutional Court determined that using the “receptación patrimonial” laundering modality for 2011–2016 campaign funds would unlawfully apply a provision added only on November 26, 2016.
  • Certain allegations persist, including false declaration and falsedad genérica against Fujimori and several associates, and the judge returned the July 2, 2025 filing to prosecutors for a new, limited pronouncement; laundering accusations also remain for Mark Vito Villanella and MVV Bienes Raíces.
  • Fujimori’s attorney said she will not pursue compensation for the 15 months her client spent in preventive detention.
