Peru’s Indecopi Upholds Fines and Seizures in Adidas, Nike and Gucci Counterfeit Case

The final rulings close the administrative case, signaling stricter market oversight for importers and retailers.

  • The IP chamber of Indecopi confirmed, in the second and final administrative instance, three sanctions against Jaime Alexander Soto Bernuy for unauthorized use of Adidas, Nike and Gucci trademarks on imported sneakers.
  • The penalties total 6.73 UIT, equal to S/36,005.50, recorded in Resolutions No. 1608-2025, 1190-2025 and 1609-2025.
  • The orders include permanent seizure of the counterfeit footwear and a prohibition on using the imitative signs, with the products withdrawn from the market.
  • Individual fines were 4.43 UIT linked to Adidas, 1.17 UIT linked to Gucci and 1.13 UIT linked to Nike after findings such as Adidas’s three stripes, the label “GUCC FASHION SHOES,” and Nike logos and the term “AIR.”
  • The brands lodged complaints in May 2023, and Indecopi warned importers and sellers to verify authenticity given active brand surveillance and the risk of similar enforcement actions.
