Peru’s Constitution Committee Backs 3‑Day Poll Blackout, Preserves 48‑Hour ‘Ley Seca’

The full Congress now considers the polling changes, with the 48‑hour alcohol sales ban unchanged.

Overview

  • Lawmakers voted 16–5, with 3 abstentions, to shorten the survey publication blackout from seven days to 72 hours before voting.
  • A separate bid to repeal the ‘Ley Seca’ failed 9–12, leaving the election‑period sales prohibition on alcoholic beverages in place.
  • Only pollsters registered with the JNE could publish voting‑intention surveys or simulations up to three days before election day, and exit polls would remain allowed after polls close.
  • The draft mandates full technical disclosure with each survey, makes the firm’s legal representative responsible, and authorizes JNE fines of 10–100 UIT (about S/53,500 to S/535,000) for violations.
  • The committee’s decision advances to the Pleno for debate and a final vote, and if approved the changes are intended to apply to the 2026 electoral calendar.
