Peru’s Congress Publishes Bicameral Rules, Making the Senate Indissoluble

The frameworks take effect upon the JNE’s proclamation of the 2026 results, linking the bicameral launch to the electoral calendar.

Overview

  • Three legislative resolutions published in El Peruano formalize the new rulebooks for the Senate, the Chamber of Deputies and overall congressional operations.
  • The Senate is declared indissoluble under Article 134 of the Constitution and remains fully functional during any interregnum if the Chamber of Deputies is dissolved.
  • The upper house will have at least 60 senators serving five-year terms, while the lower house will seat 130 deputies elected on April 12, 2026.
  • Both rulebooks take effect the day after the JNE proclaims the 2026 results, with the Chamber of Deputies’ leadership elected by July 26 and installation on July 27, 2026.
  • Exclusive Senate powers include selecting the ombudsman, appointing the comptroller, choosing Constitutional Court magistrates, electing BCR directors and ratifying its president, and ratifying the SBS superintendent, while the Chamber of Deputies retains tools to interpellate and censure ministers, require the prime minister’s policy presentation without a confidence vote, and initiate presidential vacancy with a two-thirds vote subject to Senate review.
